| Official Journal of the European Union | EN L series ---|---|--- * * * | 2026/1441 | 3.7.2026 ---|---|--- COMMISSION IMPLEMENTING DECISION (EU) 2026/1441 of 25 June 2026 approving the United States’ request for reciprocal access under the Ukraine Facility established by Regulation (EU) 2024/792 of the European Parliament and of the Council THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Regulation (EU) 2024/792 of the European Parliament and of the Council of 29 February 2024 establishing the Ukraine Facility (1), and in particular Article 11(2) thereof, Whereas: (1) | The Ukraine Facility makes financial support of up to EUR 50 billion available to Ukraine for the period 2024 to 2027 in the form of non-repayable support and loans for the recovery, reconstruction and modernisation of Ukraine. ---|--- (2) | Cooperation with the Union’s international partners is essential for the recovery, reconstruction and modernisation of Ukraine. The United States of America is a key partner of the Union in supporting Ukraine’s recovery, reconstruction and modernisation. It is co-chair of the Ukraine Donor Platform established in December 2022 by G7 leaders and is a member of its Steering Committee. ---|--- (3) | On 9 September 2025, the United States submitted a request to the Commission for reciprocal access for businesses and entities to the procurement and grant award procedures and prize contests of the respective Ukraine support programmes. ---|--- (4) | The Commission has examined the information provided by the United States and analysed the available information on international support provided to Ukraine, with a view to determining whether the United States’ support is actually and effectively not restricted and comparing the level of support provided by the Union and the United States, taking into account qualitative and quantitative aspects. ---|--- (5) | The United States does not restrict participation to projects funded in Ukraine, and grants equal access to the procurement and grant and prize award procedures of its support to Ukraine to all eligible countries under the Ukraine Facility. ---|--- (6) | From February 2022 until March 2026, the United States has committed USD 132 billion to Ukraine, with USD 70,6 billion in military commitments, USD 38,1 billion in non-military commitments and USD 4,2 billion in humanitarian assistance. Additionally, the United States has committed USD 20 billion as part of the ‘Extraordinary Revenue Acceleration loans for Ukraine’ initiative. The total support to Ukraine equates to an average of 0,46 % of the United States GDP. That, together with contributions in, among others, defence and intelligence capabilities, is comparable to the Union’s support to Ukraine (from the Union budget and Member States’ budgets combined) which amounts to 1,11 % of EU GDP. ---|--- (7) | The support provided by the United States has been crucial to Ukraine since the beginning of the full-scale invasion. The budget support provided by the United States has been essential to ensure macro-financial stability, and the military assistance could not be replaced by other donors, due to its highly advanced military equipment, including air defence systems, and its extensive intelligence and satellite network. ---|--- (8) | The United States has been the largest provider of grant support to Ukraine since February 2022 with a total of USD 38 billion. Grant contributions are crucial to ensuring Ukraine’s debt sustainability. ---|--- (9) | Alongside substantial monetary contributions, the United States has provided Ukraine with essential military equipment, intelligence and training, providing contributions to Ukraine’s right to self-defence that would not have been possible otherwise. ---|--- (10) | The United States’ continued support to Ukraine contributes to Europe’s security, and to international burden sharing between the EU and its partners as regards support to Ukraine. ---|--- (11) | On the basis of the information provided by the United States, granting the United States reciprocal access to procurement and grant and prize award procedures for activities financed under the Ukraine Facility would reinforce the shared political and economic objectives of both parties, particularly in support of Ukraine’s recovery, reconstruction and modernisation, in line with the objectives of the Ukraine Facility. ---|--- (12) | In order to maximise the effectiveness of aid provided to Ukraine, it is appropriate to grant the United States reciprocal access for a period of one year. ---|--- (13) | Ukraine has been consulted on 21 April 2026 regarding the United States’ request for reciprocal access to the Ukraine Facility, and has confirmed its agreement. ---|--- (14) | The measures provided for in this Decision are in accordance with the opinion of the Ukraine Facility Committee, ---|--- HAS ADOPTED THIS DECISION: Article 1 The United States is granted reciprocal access to procurement and grant and prize award procedures for activities financed under the Ukraine Facility, for a period of one year from 23 July 2026. Article 2 This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union. Done at Brussels, 25 June 2026.
