By its decisions of 13 September 2023(1), and 10(2)and 24 April 2024(3)respectively, the European Parliament amended its Rules of Procedure with a view to strengthening integrity, independence and accountability and implementing the parliamentary reform ‘Parliament 2024’, prompting,inter alia, a renumbering of most of the provisions of its Rules of Procedure.

| Official Journal of the European Union | EN C series ---|---|--- * * * | C/2024/4522 | 16.7.2024 ---|---|--- DECISION OF THE BUREAU OF THE EUROPEAN PARLIAMENT of 15 July 2024 amending certain Decisions of the Bureau of the European Parliament to update references to the Rules of Procedures and the Implementing Measures for the Statute for Members of the European Parliament (C/2024/4522) THE BUREAU OF THE EUROPEAN PARLIAMENT, Having regard to Rule 25(2) and (3) of the Rules of Procedure of the European Parliament, Whereas: (1) | By its decisions of 13 September 2023 (1), and 10 (2) and 24 April 2024 (3) respectively, the European Parliament amended its Rules of Procedure with a view to strengthening integrity, independence and accountability and implementing the parliamentary reform ‘Parliament 2024’, prompting, inter alia, a renumbering of most of the provisions of its Rules of Procedure. ---|--- (2) | Furthermore, over recent years the applicable legal framework referred to in a number of Bureau decisions has evolved, and therefore certain references have become manifestly obsolete or need to be updated, as is, notably, the case of references to the Bureau Decision concerning the Implementing Measures for the Statute for Members of the European Parliament (4) (‘the IMMS’). ---|--- (3) | Against that background and with a view to providing an up-to-date and reliable legal framework, the relevant provisions of the following Bureau decisions, should be amended to reflect the updated references to Rules of Procedure and to the IMMS: | — | Bureau decision of 28 November 2001 on the rules governing public access to European Parliament documents (5); ---|--- — | Bureau decision of 23 March 2011 on the rules concerning the ban on smoking in the European Parliament premises (6); ---|--- — | Bureau decision of 15 April 2013 concerning the rules governing the treatment of confidential information by the European Parliament (7); ---|--- — | Bureau decision of 15 January 2018 on the rules governing security and safety in the European Parliament (8); ---|--- — | Bureau decision of 17 June 2019 on the implementing rules relating to Regulation (EU) 2018/1725 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data by the Union Institutions, Bodies, Offices and Agencies and on the free movement of such data, and repealing Regulation (EC) No 45/2001 and Decision No 1247/2002/EC (9); ---|--- — | Bureau decision of 1 July 2019 laying down the procedures for implementing Regulation (EU, Euratom) No 1141/2014 of the European Parliament and of the Council on the statute and funding of European political parties and European political foundations (10), ---|--- HAS ADOPTED THIS DECISION: Article 1 The Decision of the Bureau of the European Parliament of 28 November 2001 on the rules governing public access to European Parliament documents is amended as follows: (1) | The third citation is replaced by the following: ‘Having regard to Rules 25(2) and (12), 124(1) and 125 of the Rules of Procedure,’; ---|--- (2) | The third recital is replaced by the following: ‘Whereas, pursuant to Rule 125(2), (3) and (4) of the Rules of Procedure, the Bureau is required to adopt rules establishing a register of references of documents, to lay down arrangements for access to and to determine the bodies responsible for the handling of applications for access,’; ---|--- (3) | In Article 4, paragraph 2 is replaced by the following: ‘2. European Parliament documents as defined by Rule 125(2) of the European Parliament's Rules of Procedure shall be recorded in the ERR under the responsibility of the body or service which is the originator of the document.’ ; ---|--- (4) | In Article 12, paragraph 1 is replaced by the following: ‘1. Initial applications submitted to the European Parliament shall be handled by the Secretary-General under the authority of the Vice-President responsible for supervision of the handling of applications for access to documents, as provided for by Rule 125(4) and (5) of the European Parliament's Rules of Procedure.’ . ---|--- Article 2 In the Decision of the Bureau of the European Parliament of 23 March 2011 on the rules concerning the ban on smoking in the European Parliament premises, the first citation is replaced by the following: ‘Having regard to Rule 25(2) of Parliament's Rules of Procedure,’. Article 3 The Decision of the Bureau of the European Parliament of 15 April 2013 concerning the rules governing the treatment of confidential information by the European Parliament is amended as follows: (1) | The first citation is replaced by the following: ‘Having regard to Rule 25(12) of the Rules of Procedure of the European Parliament,’; ---|--- (2) | In Annex II, the Security notice 6, point 9, is replaced by the following: | ‘9. | Without prejudice to other legal action, breaches committed by Members of the European Parliament shall be dealt with in accordance with Rule 10(5) and Rules 182, 183 and 184 of Parliament's Rules of Procedure,’. ---|--- Article 4 The Decision of the Bureau of the European Parliament of 15 January 2018 on the rules governing security and safety in the European Parliament is amended as follows: (1) | Recital 10 is replaced by the following: | ‘(10) | Matters relating to access badges are governed by a separate Decision of the Bureau adopted on the basis of Rule 126(1) of Parliament’s Rules of Procedure.’ ---|--- ; (2) | In Article 3, paragraph 8 is replaced by the following: ‘8. This Decision shall not apply to rules on access badges within the meaning of Rule 126 of Parliament’s Rules of Procedure.’ ; ---|--- (3) | In Article 6, paragraph 4 is replaced by the following: ‘4. In the event that a Member disrupts the proper conduct of proceedings of the plenary, the Secretary-General may request the assistance of DG SAFE when measures according to Rule 182(3) of the Rules of Procedure of the European Parliament are adopted.’ ; ---|--- (4) | In Article 10, paragraph 3 is replaced by the following: ‘3. Non-compliance with this Decision, its implementing rules, as well as with the measures taken in their application may trigger disciplinary action in accordance with the Treaties, Rules 10 and 183 of the Parliament’s Rules of procedure, the Staff Regulations, contractual sanctions or legal action under national laws and regulations.’ ; ---|--- (5) | In Article 28, paragraph 4, the first indent is replaced by the following: | ‘— | assist or support an investigation which has been opened by the President into a Member under Rule 183 of Parliament’s Rules of Procedure;’. ---|--- Article 5 In the Decision of the Bureau of the European Parliament of 17 June 2019 on the implementing rules relating to Regulation (EU) 2018/1725 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data by the Union Institutions, Bodies, Offices and Agencies and on the free movement of such data, and repealing Regulation (EC) No 45/2001 and Decision No 1247/2002/EC, footnote 7 is replaced by the following: ‘(7) | Bureau Decision of 11 September 2023 concerning the Implementing Measures for the Statute for Members of the European Parliament and repealing the Decision of the Bureau of 19 May and 9 July 2008 (OJ C/2024/2814, 26.4.2024, ELI: http://data.europa.eu/eli/C/2024/2814/oj).’. ---|--- Article 6 The Decision of the Bureau of the European Parliament of 1 July 2019 laying down the procedures for implementing Regulation (EU, Euratom) No 1141/2014 of the European Parliament and of the Council on the statute and funding of European political parties and European political foundations is amended as follows: (1) | The sixth citation is replaced by the following: ‘Having regard to the European Parliament’s Rules of Procedure (“the Rules of Procedure”), and in particular Rules 25(11) and 241 thereof,’; ---|--- (2) | In Article 8, paragraph 9 is replaced by the following: ‘9. The decisions adopted under this Article shall be notified to the beneficiary as a uniform decision, in accordance with Rule 241(1) of the Rules of Procedure.’ ; ---|--- (3) | In Article 9, paragraph 2 is replaced by the following: ‘2. Rule 241(1), third subparagraph, of the Rules of Procedure shall apply to decisions adopted by the Bureau under this Article.’ ; ---|--- (4) | In Article 10, paragraph 2 is replaced by the following: ‘2.
