**Important legal notice** _|_ # 52004DP0093 **European Parliament decision on the request for waiver of the immunity of Rainer Wieland (2004/2174(IMM))** _ Official Journal 226 E , 15/09/2005 P. 0050 - 0050 _ P6_TA(2004)0093 Request for the waiver of Mr Rainer Wieland's parliamentary immunity European Parliament decision on the request for waiver of the immunity of Rainer Wieland (2004/2174(IMM)) The European Parliament, \- having regard to the request for waiver of the immunity of Rainer Wieland forwarded by the Ministry of Justice of the Federal Republic of Germany on 17 August 2004 and announced in plenary sitting on 13 September 2004, \- having given Rainer Wieland the opportunity to be heard pursuant to Rule 7(3) of its Rules of Procedure, whereupon he declared that he would not oppose the waiver of his parliamentary immunity, \- having regard to Article10 of the Protocol on the Privileges and Immunities of the European Communities of 8 April 1965, and to Article 6(2) of the Act concerning the election of the members of the European Parliament by direct universal suffrage, of 20 September 1976, \- having regard to the judgments of the Court of Justice of the European Communities of 12 May 1964 and 10 July 1986 [1], \- having regard to Article46 of the Basic Law of the Federal Republic of Germany, \- having regard to Rules 6(2) and 7 of its Rules of Procedure, \- having regard to the report of the Committee on Legal Affairs (A6-0059/2004), 1\. Decides to waive the immunity of Rainer Wieland; 2\. Instructs its President immediately to forward this decision and the report of its committee responsible to the appropriate authorities of the Federal Republic of Germany.
