19.9.2018 | EN | Official Journal of the European Union | C 334/231 ---|---|---|--- * * * P8_TA(2017)0291 Non-objection to a delegated act: European order for payment procedure European Parliament decision to raise no objections to the Commission delegated regulation of 19 June 2017 replacing Annex I to Regulation (EC) No 1896/2006 of the European Parliament and of the Council creating a European order for payment procedure (C(2017)03984 — 2017/2747(DEA)) (2018/C 334/30) The European Parliament, — | having regard to the Commission delegated regulation (C(2017)03984), ---|--- — | having regard to the Commission’s letter of 19 June 2017 asking Parliament to declare that it will raise no objections to the delegated regulation, ---|--- — | having regard to the letter from the Committee on Legal Affairs to the Chair of the Conference of Committee Chairs of 22 June 2017, ---|--- — | having regard to Article 290 of the Treaty on the Functioning of the European Union, ---|--- — | having regard to Regulation (EC) No 1896/2006 of the European Parliament and of the Council of 12 December 2006 creating a European order for payment procedure (1), as amended by Regulation (EU) 2015/2421 of the European Parliament and of the Council (2), and in particular Articles 30 and 31(5) thereof, ---|--- — | having regard to the recommendation for a decision of the Committee on Legal Affairs, ---|--- — | having regard to Rule 105(6) of its Rules of Procedure, ---|--- — | having regard to the fact that no objections have been raised within the period laid down in the third and fourth indents of Rule 105(6) of its Rules of Procedure, which expired on 4 July 2017, ---|--- A. | whereas the annexes to Regulation (EC) No 1896/2006 set out the forms to be used to facilitate its application; ---|--- B. | whereas Regulation (EC) No 1896/2006 was amended by Regulation (EU) 2015/2421, which will apply from 14 July 2017; whereas the changes made to the European order for payment procedure should be reflected in Annex I to Regulation (EC) No 1896/2006; ---|--- C. | whereas it is necessary to replace Annex I to Regulation (EC) No 1896/2006 and whereas the new Annex I should apply at the same time as Regulation (EU) 2015/2421; ---|--- D. | whereas the amendments to Regulation (EC) No 1896/2006 will start to apply on 14 July 2017, and the delegated regulation should therefore enter into force on 14 July 2017; ---|--- | 1. | Declares that it has no objections to the delegated regulation; ---|---|--- | 2. | Instructs its President to forward this decision to the Council and the Commission. ---|---|--- * * * (1) OJ L 399, 30.12.2006, p. 1.
