29.10.2021 | EN | Official Journal of the European Union | C 445/227 ---|---|---|--- * * * P9_TA(2020)0350 Non-objection to a delegated act: Identification mark to be used for certain products of animal origin in the United Kingdom in respect of Northern Ireland European Parliament decision to raise no objections to the Commission delegated regulation of 7 December 2020 amending Annex II to Regulation (EC) No 853/2004 of the European Parliament and of the Council as regards the identification mark to be used for certain products of animal origin in the United Kingdom in respect of Northern Ireland (C(2020)08765 — 2020/2907(DEA)) (2021/C 445/37) The European Parliament, — | having regard to the Commission delegated regulation of 7 December 2020 amending Annex II to Regulation (EC) No 853/2004 of the European Parliament and of the Council as regards the identification mark to be used for certain products of animal origin in the United Kingdom in respect of Northern Ireland (C(2020)08765), ---|--- — | having regard to the Commission’s letter of 7 December 2020 asking Parliament to declare that it will raise no objections to the delegated regulation, ---|--- — | having regard to the letter from the Committee on the Environment, Public Health and Food Safety to the Chair of the Conference of Committee Chairs of 11 December 2020, ---|--- — | having regard to Article 290 of the Treaty on the Functioning of the European Union, ---|--- — | having regard to Regulation (EC) No 853/2004 of the European Parliament and of the Council of 29 April 2004 laying down specific hygiene rules for food of animal origin (1), and in particular Articles 10(1) and 11a(6) thereof, ---|--- — | having regard to Rule 111(6) of its Rules of Procedure, ---|--- — | having regard to the recommendation for a decision of the Committee on the Environment, Public Health and Food Safety, ---|--- — | having regard to the fact that no objections have been raised within the period laid down in the third and fourth indents of Rule 111(6) of its Rules of Procedure, which expired on 15 December 2020, ---|--- A. | whereas Regulation (EC) No 853/2004 lays down specific hygiene rules for food of animal origin for food business operators, and in particular Annex II to that Regulation sets out requirements concerning the identification mark to be applied by food business operators on certain products of animal origin, including requirements concerning the country codes to be used by Member States and third countries; ---|--- B. | whereas, in accordance with the Agreement on the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community (Withdrawal Agreement), and in particular Article 5(4) of the Protocol on Ireland/Northern Ireland in conjunction with Annex 2 to that Protocol, Regulation (EC) No 853/2004, as well as the Commission acts based on it, applies to and in the United Kingdom in respect of Northern Ireland after the end of the transitional period; whereas, for that reason, it is necessary to amend the requirements laid down in Annex II to that Regulation concerning the identification mark that should be used in the United Kingdom in respect of Northern Ireland; ---|--- C. | whereas, on 7 December 2020, the Commission transmitted to Parliament the delegated regulation, which opened the two-month scrutiny period for Parliament to object to that delegated regulation; ---|--- D. | whereas the delegated regulation adapts the identification mark to be applied on products of animal origin produced in Northern Ireland; ---|--- E. | whereas the delegated regulation should apply from 1 January 2021, in order to ensure that the measures provided in that regulation are effective after the transition period in the Withdrawal Agreement ends on 31 December 2020; ---|--- | 1. | Declares that it has no objections to the delegated regulation; ---|---|--- | 2. | Instructs its President to forward this decision to the Council and the Commission. ---|---|--- * * * (1) OJ L 139, 30.4.2004, p. 55. * * *
