22.5.2007 | EN | Official Journal of the European Union | L 130/3 ---|---|---|--- * * * COMMISSION REGULATION (EC) No 548/2007 of 21 May 2007 adapting several regulations concerning the export refunds on fruit and vegetables and certain products processed from them by reason of the accession of Bulgaria and Romania to the European Union THE COMMISSION OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty of Accession of Bulgaria and Romania, Having regard to the Act of Accession of Bulgaria and Romania, and in particular Article 56 thereof, Whereas: (1) | Certain technical amendments are necessary in several Commission Regulations concerning the export refunds on fruit and vegetables and certain products processed from them in order to carry out the necessary adaptations by reason of the accession of Bulgaria and Romania to the European Union. ---|--- (2) | Commission Regulation (EC) No 1429/95 of 23 June 1995 on implementing rules for export refunds on products processed from fruit and vegetables other than those granted for added sugars (1) contains certain entries in all Community languages. That Regulation should include those entries in Bulgarian and Romanian. ---|--- (3) | Commission Regulation (EC) No 1591/95 of 30 June 1995 laying down detailed rules for the application of export refunds to glucose and glucose syrup used in certain products processed from fruit and vegetables (2) contains certain entries in all Community languages. That Regulation should include those entries in Bulgarian and Romanian. ---|--- (4) | Commission Regulation (EC) No 2315/95 of 29 September 1995 laying down detailed rules for the application of export refunds to certain sugars covered by the common organization of the market in sugar used in certain products processed from fruit and vegetables (3) contains certain entries in all Community languages. That Regulation should include those entries in Bulgarian and Romanian. ---|--- (5) | Commission Regulation (EC) No 1961/2001 of 8 October 2001 laying down detailed rules for implementing Council Regulation (EC) No 2200/96 as regards export refunds on fruit and vegetables (4) contain certain entries in all Community languages. That Regulation should include those entries in Bulgarian and Romanian. ---|--- (6) | Regulations (EC) No 1429/95, (EC) No 1591/95, (EC) No 2315/95 and (EC) No 1961/2001 should therefore be amended accordingly, ---|--- HAS ADOPTED THIS REGULATION: Article 1 Regulation (EC) No 1429/95 is amended as follows: 1. | in Article 3, the paragraph 3 is replaced by the following: ‘3. Box 22 of the licence shall contain one of the entries listed in the Annex.’; ---|--- 2. | the text in Annex I to this Regulation is added as Annex. ---|--- Article 2 Regulation (EC) No 1591/95 is amended as follows: 1. | in Article 2 of, the second paragraph is replaced by the following: ‘However, for the purpose of applying this Regulation, section 20 of the licence application and of the licence shall contain one of the entries listed in the Annex.’; ---|--- 2. | the text in Annex II to this Regulation is added as an Annex. ---|--- Article 3 Regulation (EC) No 2315/95 is amended as follows: 1. | in Article 2(1) of the point (b) is replaced by the following: | ‘(b) | Section 20 of the licence application and of the licence shall contain one of the entries listed in the Annex.’; ---|--- 2. | the text in Annex III to this Regulation is added as an Annex. ---|--- Article 4 Regulation (EC) No 1961/2001 is amended as follows: 1. | in Article 3(2), the first subparagraph is replaced by the following: ‘Box 20 of licence applications shall contain at least one of the entries listed in Annex Ia, with the minimum rate of refund sought by the applicant in order to be able to export expressed by a whole number of euros per tonne net weight.’; ---|--- 2. | Article 5 is amended as follows: | (a) | paragraph 2 is replaced by the following: ‘2. Box 22 of licences shall show at least one of the entries listed in Annex Ib.’; ---|--- (b) | in paragraph 6, the fourth subparagraph is replaced by the following: ‘Where the date on which the term of validity begins is not the same as the date of issue referred to in the first subparagraph, box 22 of the licence shall contain one of the entries listed in Annex Ic.’; ---|--- (c) | paragraph 7 is replaced by the following: ‘7. The refund rate applicable shall be indicated in box 22 of the licence by means of one of the entries listed in Annex Id.’; ---|--- 3. | Article 6 is amended as follows: | (a) | paragraph 2 is replaced by the following: ‘2. Licence applications must be accompanied by a copy of the export declaration for the products. The declaration must contain at least one of the entries listed in Annex Ie.’; ---|--- (b) | paragraph 4 is replaced by the following: ‘4. Box 20 of licence applications and licences shall show at least one of the entries listed in Annex If.’; ---|--- (c) | in paragraph 8, the first subparagraph is replaced by the following: ‘Export licences shall be issued on the 14th working day after the end of the export period for that period. Box 22 of licences shall contain at least one of the entries listed in Annex Ig, along with the refund rate fixed in accordance with the first subparagraph of paragraph 7, and the quantity, reduced if necessary by the percentage referred to in the second subparagraph of paragraph 7.’; ---|--- 4. | the text in Annex IV to this Regulation is inserted as Annexes Ia, Ib, Ic, Id, Ie, If and Ig. ---|--- Article 5 This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Union.
