4.3.2021 | EN | Official Journal of the European Union | L 76/1 ---|---|---|--- * * * COMMISSION IMPLEMENTING DECISION (EU) 2021/385 of 2 March 2021 amending Annex II to Decision 93/52/EEC as regards the officially brucellosis (B. melitensis)-free status, Annexes I and II to Decision 2003/467/EC as regards the officially tuberculosis- and brucellosis-free status and Annexes I and II to Decision 2008/185/EC as regards the free status and the approval of the eradication programmes for Aujeszky’s disease for certain regions (notified under document C(2021) 1064) (Text with EEA relevance) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Functioning of the European Union, Having regard to Council Directive 64/432/EEC of 26 June 1964 on animal health problems affecting intra-Community trade in bovine animals and swine (1), and in particular Articles 9(2) and 10(2) thereof, and paragraph 4 of Annex A.I and paragraph 7 of Annex A.II thereto, Having regard to Council Directive 91/68/EEC of 28 January 1991 on animal health conditions governing intra-Community trade in ovine and caprine animals (2), and in particular Section II of Chapter 1 of Annex A thereto, Whereas: (1) | Directive 91/68/EEC establishes the animal health conditions governing trade in the Union in ovine and caprine animals. It lays down the conditions whereby Member States or regions thereof may be recognised as officially free of brucellosis (B. melitensis) as regards ovine and caprine herds. ---|--- (2) | Commission Decision 93/52/EEC (3) provides that the regions of the Member States listed in Annex II thereto are recognised as officially free of brucellosis (B. melitensis) as regards ovine and caprine herds, in accordance with the conditions laid down in Directive 91/68/EEC. ---|--- (3) | France has submitted to the Commission documentation demonstrating compliance for the department of Pyrénées-Atlantiques in the region of Nouvelle-Aquitaine with the conditions laid down in Directive 91/68/EEC in order to be recognised as officially free of brucellosis (B. melitensis) as regards ovine and caprine herds. ---|--- (4) | Italy has submitted to the Commission documentation demonstrating compliance for the region of Abruzzo, the provinces of Catanzaro and Cosenza in the region of Calabria, the province of Benevento in the region of Campania and the provinces of Bari, Barletta-Andria-Trani and Taranto in the region of Apulia with the conditions laid down in Directive 91/68/EEC in order to be recognised as officially free of brucellosis (B. melitensis) as regards ovine and caprine herds. ---|--- (5) | Spain has submitted to the Commission documentation demonstrating compliance for the provinces of Almeria, Granada, Jaén and Málaga in the Autonomous Community of Andalusia with the conditions laid down in Directive 91/68/EEC in order to be recognised as officially free of brucellosis (B. melitensis) as regards ovine and caprine herds. ---|--- (6) | Following the evaluation of that supporting documentation, the department of Pyrénées-Atlantiques in the region of Nouvelle-Aquitaine in France, the region of Abruzzo, the provinces of Catanzaro and Cosenza in the region of Calabria, the province of Benevento in the region of Campania and the provinces of Bari, Barletta-Andria-Trani and Taranto in the region of Apulia in Italy and the provinces of Almeria, Granada, Jaén and Málaga in the Autonomous Community of Andalusia in Spain should be recognised as officially free of brucellosis (B. melitensis) as regards ovine and caprine herds. ---|--- (7) | Annex II to Decision 93/52/EEC should therefore be amended accordingly. ---|--- (8) | Directive 64/432/EEC applies to trade within the Union in bovine and porcine animals. It lays down the conditions whereby a Member State or regions thereof may be recognised as officially tuberculosis-free and officially brucellosis-free as regards bovine herds. ---|--- (9) | Article 1(2) of Commission Decision 2003/467/EC (4) provides that regions of Member States listed in Chapter 2 of Annex I thereto are declared officially tuberculosis-free as regards bovine herds. ---|--- (10) | Italy has submitted to the Commission documentation demonstrating compliance for the region of Molise, the province of Matera in the region of Basilicata and the province of South Sardinia in the region of Sardinia with the conditions laid down in Directive 64/432/EEC in order to be recognised as officially tuberculosis-free regions as regards bovine herds. ---|--- (11) | Following the evaluation of that supporting documentation, the region of Molise, the province of Matera in the region of Basilicata and the province of South Sardinia in the region of Sardinia should be recognised as officially free of tuberculosis as regards bovine herds. ---|--- (12) | Annex I to Decision 2003/467/EC should therefore be amended accordingly. ---|--- (13) | Article 2(2) of Decision 2003/467/EC provides that regions of Member States listed in Chapter 2 of Annex II thereto are declared officially brucellosis-free as regards bovine herds. ---|--- (14) | Italy has submitted to the Commission documentation demonstrating compliance for the provinces of Bari, Barletta-Andria-Trani and Lecce in the region of Apulia and the provinces of Avellino, Benevento and Napoli in the region of Campania with the conditions laid down in Directive 64/432/EEC in order to be recognised as officially brucellosis-free regions as regards bovine herds. ---|--- (15) | Spain has submitted to the Commission documentation demonstrating compliance for the provinces of Cádiz, Córdoba, Huelva, Málaga and Sevilla in the Autonomous Community of Andalusia and of the provinces Ávila, Palencia and Segovia in the Autonomous Community of Castilla y León with the conditions laid down in Directive 64/432/EEC in order to be recognised as officially brucellosis-free regions as regards bovine herds. ---|--- (16) | Following the evaluation of that supporting documentation, the provinces of Bari, Barletta-Andria-Trani and Lecce in the region of Apulia and the provinces of Avellino, Benevento and Napoli in the region of Campania in the region of Campania in Italy and the provinces of Cádiz, Córdoba, Huelva, Málaga and Sevilla in the Autonomous Community of Andalusia and of the provinces Ávila, Palencia and Segovia in the Autonomous Community of Castilla y León in Spain should be recognised as officially free of brucellosis as regards bovine herds. ---|--- (17) | Annex II to Decision 2003/467/EC should therefore be amended accordingly. ---|--- (18) | Commission Decision 2008/185/EC (5) lays down additional guarantees for movements of pigs between Member States. Those guarantees are linked to the classification of the Member States or regions thereof according to their disease status for Aujeszky’s disease. Annex I to that Decision lists the Member States or regions thereof free of Aujeszky’s disease. ---|--- (19) | Estonia has submitted to the Commission documentation demonstrating compliance for the whole territory of that Member State with the conditions laid down in Decision 2008/185/EC in order to be recognised as free of Aujeszky’s disease. ---|--- (20) | Following the evaluation of that supporting documentation, Estonia should be recognised as free of Aujeszky’s disease. ---|--- (21) | Annex I to Decision 2008/185/EC should therefore be amended accordingly. ---|--- (22) | Annex II to Decision 2008/185/EC lists the Member States or regions thereof where approved national control programmes for the eradication of Aujeszky’s disease are in place. ---|--- (23) | Italy has submitted to the Commission supporting documentation for the approval of its control programmes for the eradication of Aujeszky’s disease for 13 Regions and for these regions to be duly listed in Annex II to Decision 2008/185/EC. ---|--- (24) | Portugal has submitted to the Commission supporting documentation for the approval of its control programmes for the eradication of Aujeszky’s disease for the whole territory of that Member State and for this Member State to be duly listed in Annex II to Decision 2008/185/EC. ---|--- (25) | Following the evaluation of that supporting documentation, the control programmes for the eradication of Aujeszky’s disease for 13 regions of Italy and for Portugal should be approved. ---|--- (26) | Annex II to Decision 2008/185/EC should therefore be amended accordingly. ---|--- (27) | The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, ---|--- HAS ADOPTED THIS DECISION: Article 1 Annex II to Decision 93/52/EEC is amended as set out in Annex I to this Decision. Article 2 Decision 2003/467/EC is amended as follows: (a) | Annex I is amended as set out in Annex II to this Decision; ---|--- (b) | Annex II is amended as set out in Annex III to this Decision. ---|--- Article 3 Decision 2008/185/EC is amended as follows: (a) | Annex I is amended as set out in Annex IV to this Decision; ---|--- (b) | Annex II is amended as set out in Annex V to this Decision. ---|--- Article 4 This Decision is addressed to the Member States.
