About this statute

The Marriage Act enters into force on 1 January 1930 and repeals several earlier marriage-related rules, except for specified disqualification rules that remain unchanged. For spouses who married before the Marriage Act took effect, the earlier law still applies unless sections 3 or 4 say otherwise. Puolisot eivät saa tehdä keskenään sopimuksia muista asioista kuin laissa erikseen mainituista, mutta voivat tehdä avioehtosopimuksen tietyistä omaisuutta koskevista järjestelyistä. This section extends certain Marriage Act rules to spouses married before the Act took effect, limits a wife’s ability to transfer or mortgage certain inherited/gifted/property-covered assets without following specified rules, and gives spouses a right to separation of estate when they agree. Where a rule refers to a wife or widow, it also applies, when applicable, to a husband or widower.
