Statute overview

About this statute

A detained person must be taken promptly to a public prison or an approved detention facility, with limited exceptions allowing other places or supervised transport when permitted. A remand prisoner’s freedom may be limited only as needed for the detention’s purpose, safe custody, and maintaining order. When a prisoner is moved outside the institution, unnecessary attention should be avoided. A remand prisoner may be granted supervised leave from the institution to visit a seriously ill close relative, attend a close relative’s funeral, or for another very important reason. Rannsakningsfångar may be searched, body-searched, inspected, and tested in prison, with witness requirements and decisions by specified prison officials.
