About this statute

Chapter heading for general provisions. A mortgage association is a credit institution and its special purpose is to grant long-term loans, mainly against mortgage security or other adequate security. A mortgage association’s firm name must include the word “hypoteksförening,” and only a mortgage association may use that designation for its firm or business description. Hypoteksföreningens stiftare är medlemmar i fem år efter bildandet, och låntagare är också medlemmar, utom de som bara fått statliga medel. Medlemmar ansvarar inte för föreningens skulder och har ingen rätt till dess egendom eller vinstandel. A mortgage association may be formed by at least 20 natural or legal persons, but at least half of the founders must be resident in the EEA (or, for legal persons, have their registered office there) unless Finansinspektionen grants an exemption. Minors and persons in bankruptcy cannot be founders, and a written founding agreement must be made.
