Statute overview

About this statute

Chapter heading: military members of the court. Military members of the court must serve in the armed forces or border guard and have the required military and technical expertise. A defence-area commander must promptly notify the court about a military member’s term ending or service changes, and must request appointment of a new member or substitute. The Ministry of Defence must also notify the Ministry of Justice and submit a proposal for a military member or substitute to the Supreme Court process. A military member’s service in the defence forces must not stop him from carrying out duties under the Military Procedure Act, unless ordinary service duties require otherwise. Åklagaren måste informera kommendören i vissa militärärenden och skicka tillbaka undersökningshandlingarna om åtal inte väcks.
