About this statute

Legal aid is granted based on the applicant’s available means and assets, and the recipient’s self-risk consists of a base self-risk and an additional self-risk. Sökandens disponibla medel beräknas genom avdrag för skatt, vissa lagstadgade arbetstagaravgifter, vissa nödvändiga utgifter och vissa barnavdrag, med särskilda regler för barn och förmögenhet. If a person under 18 applies for legal aid, the guardians’ disposable means are not counted. If spouses are opposed to each other or live apart because of a lasting separation, legal aid is assessed only on the applicant’s finances using the amounts for a single person. A legal aid recipient must pay a basic deductible calculated as a percentage of the assistant’s fee and costs, including VAT.
