About this statute

This chapter concerns prescription (limitation periods). The right to bring criminal charges does not expire for offences punishable by life imprisonment; otherwise it expires after 20, 10, 5, or 2 years depending on the maximum penalty. This section says when the limitation period for prosecution starts to run, mainly from the day the offense was committed. Prosecution is treated as having been brought in time if the accused is properly served with a summons or if the criminal claim is made in the person’s presence at trial; a prosecution that is later dismissed or dropped does not interrupt limitation. The limitation period for prosecution may be extended once by one year on application if certain conditions are met.
