Statute overview

About this statute

Family pension is calculated from the deceased person’s qualifying state pension, with specific additions and a survivor-pension conversion rule. Family pension is coordinated with other survivor benefits, and for certain cases the coordination limit is set by a service-time-based percentage table. If a widow does not receive the pension mentioned in subsection 1, her earnings-based pension is calculated as the pension she would have received if she had become disabled to the required level on the deceased person’s death date or when the child turns 18; the same approach applies to equivalent foreign-state benefits. In pension adjustment, the widow’s pension is reduced when these earnings-based pensions exceed the adjustment basis, which is set at 649.69 euros, the relevant combined pension amount, or 324.77 euros depending on the amount. Certain amounts in this law and earnings for calculating family pension are adjusted using the wage coefficient. Valtiokonttori may pay certain small family pensions or related pensions as a lump sum, and the lump sum is calculated using criteria confirmed by the Ministry of Social Affairs and Health.
