About this statute

This section says that, for property division, certain property inherited, gifted, or received by a spouse after death or after a divorce case becomes pending is treated as property in which the other spouse has no marital property, with one exception. A debt is deducted only in limited cases: generally only if it is the deceased spouse’s debt, but a surviving spouse’s debt is also deducted in specified creditor-security or set-off situations.
