Statute overview

About this statute

Kapitlet gäller preskription. This provision sets when the right to prosecute certain offences does not expire, and gives specific limitation periods for several offence categories. The right to impose punishment for certain offences does not expire, but for other offences punishment cannot be imposed after the stated time limit, and an imposed sentence lapses if it has not become enforceable in time. A forfeiture penalty may not be imposed if the underlying offence is time-barred. The shortest limitation period for a forfeiture claim is five years, but claims about certain listed tools or other property do not time-bar. A life sentence or fixed-term prison sentence for the offences referred to in 1 § 1 mom. does not lapse. A youth sentence lapses if execution has not started within three years from the day the final judgment was given.
