About this statute

A person who cannot apply for disability benefits themselves may be represented by an approved close relative or main carer; for disability allowance for children under 16, certain guardians or care-related bodies may apply. Certain guardians or other eligible applicants must notify someone, but the source text does not show the full recipient or subject of the notice. For a child under 16 who receives disability benefit and does not live with the guardian, FPA may pay the benefit to the child’s guardian, foster carer, the designated social welfare body, or another suitable person, and must hear the social welfare body and the child’s guardian. Payment of a disability benefit may be temporarily suspended if the beneficiary does not provide a payment address when asked. Overpaid disability benefit for a child under 16 is recovered from the child’s guardian or the person who received it.
