About this statute

This section says the law concerns state capital investments to strengthen the primary capital of viable and solvent deposit banks, their holding companies, or the central institute of the cooperative bank group. The State may subscribe capital loans in certain Finnish deposit banks and related holding entities, if the issuer meets capital-base conditions. The State may subscribe capital loans up to EUR 4 billion or within the limits of state budget appropriations/authorisations, but only up to 25% of the relevant capital base requirement and only in euro. Terms for capital loans must meet the requirements of this Act and the government decree issued under section 13, in addition to what is laid down in section 45(3) of the Credit Institutions Act. In a bankruptcy, capital loans and interest are paid after all other debts, but before other capital loans covered by this law. A creditor’s right for certain older capital loans is preserved.
