If the boundaries of an ancient monument have not been set and the Museum Authority and the landowner do not agree in writing, the ELY Centre must set them on application by either party. The ELY Centre must issue special rules to preserve the value of a fixed ancient monument, and its decision must be posted on the municipality notice board and sometimes near the monument. The regional economic, transport and environment centre may grant a permit to disturb a fixed ancient monument if it causes unreasonable harm relative to its significance, after hearing the National Board of Antiquities and on application with a detailed description. If the applicant is not the landowner, the landowner must be heard. A permit decision conflicting with the Board’s opinion must be submitted to the Ministry of Education for confirmation. Museiverket may investigate certain find-sites or let someone else investigate them under conditions it sets. People who suffer damage from such an investigation are entitled to reasonable compensation from state funds. The regional state administrative office may, if needed, prohibit harmful measures with a fine. The law enters into force on 1 January 2010, and implementation measures may be taken before that.
