Statute overview

About this statute

Arbets- och näringsministeriet styr lagen och utvecklar lönegarantisystemet; Närings-, trafik- och miljöcentralen beslutar i lönegarantiärenden och sköter andra verkställighetsuppgifter. The Wage Guarantee Authority may, for justified reasons, refuse payment under the wage guarantee or review the amount in certain abuse-related situations. Wage guarantee payments for waiting-day pay are capped at the same amount payable for the underlying claims. Work-related travel or other costs are paid under the wage guarantee if they are customary and the amount is reasonable. An application must be submitted to the employment and economic office or the ELY Centre; for wage guarantee applications about work abroad, it may also be submitted to a Finnish mission abroad. The competent employment and economic development centre handles and decides wage guarantee applications, with special rules for unclear home municipality, bankruptcy, Åland, and ministerial transfer.
