About this statute

People planning to buy or increase certain holdings in a credit institution must notify the Financial Supervisory Authority in advance when specified ownership or voting thresholds are reached, and the institution and its holding company must also report ownership information and changes. En anmälningsskyldig får inte köpa vissa aktier eller andelar innan Finansinspektionen har fattat beslutet eller beslutstiden har löpt ut, om inte något annat bestäms i ärendet. A credit institution may not invest more than 15% of its capital base in shares, units, or capital loans in certain companies where it has a qualifying holding, with listed exceptions. Its total investments under the first paragraph may not exceed 60% of its capital base. Companies in a credit institution’s financial group may be subject to limits on certain investments, including a 15% cap with listed exceptions and a separate aggregate limit of 60% of the credit institution’s consolidated capital base. A person who intentionally or negligently buys or transfers credit institution shares or participations without the required notices, or in breach of a Financial Supervisory Authority ban, may be fined.
