About this statute

Förmyndarmyndigheten ska självmant utreda om fortsatt intressebevakning behövs och vid behov ansöka hos tingsrätten om att uppdraget ska upphöra. The rule in 17 b § also applies when a person’s legal capacity has been limited. A guardian may not, without permission from the guardianship authority, grant loans or buy certain financial instruments or shares on the principal’s behalf, subject to listed exceptions. Some guardians are entitled to be paid from the principal’s funds for necessary costs and a reasonable fee, with extra compensation possible for qualifying specialist work. Payment is barred when the principal’s income is at or below a stated annual level, unless assets minus debts exceed a higher threshold; the Government may issue detailed rules on the amount. The guardianship authority may extend the time set in subsection 1, and the rule in subsection 1 does not apply to a parent acting as guardian for a minor child if the child’s property is small.
