About this statute

This section defines “narcotics” and sets a process for assessing certain substances, including a requirement for the medicines authority to assess them and report to the Ministry of Social Affairs and Health. Narcotics-related production, trade, transport, handling, possession, use, import, export, and transit are prohibited, subject to listed exceptions. Permits may be granted to sole proprietors, legal persons, universities, and other research institutes for specified medicines, narcotics, research, quality control, product development, or industrial-use purposes. The licensing authority may treat an applicant as meeting the conditions without a separate inquiry if the applicant regularly applies for permits under sections 12–15 and the authority has found within the last year that the applicant’s activities meet the conditions. Universities and other research institutes may be granted a permit to manufacture narcotics for scientific research if they have a valid handling permit under section 15. A permit for certain narcotics used for industrial use may also be granted if the applicant has the required handling permit. The manufacturing permit cannot last longer than the handling permit is in force.
