About this statute

This provision is a chapter heading about how punishment is determined. This section identifies a sentencing aggravating ground: an offence committed because of motives such as race, ethnicity, religion, belief, sexual orientation, disability, or a comparable motive. Publicly spreading or providing messages that threaten, defame, or insult a group on protected grounds is punishable by fine or up to two years’ imprisonment; aggravated cases can lead to four months to four years’ imprisonment. Rules on corporate criminal liability are applied to hate speech and aggravated hate speech, and participation in an organized criminal association’s activity can lead to a fine or up to two years’ imprisonment if the listed conditions are met. This section says rules on criminal liability of legal persons apply to several listed offences, and also to certain public incitement to crime cases.
