About this statute

For certain drainage cases, the delivery officials decide on the drainage, unless a permit or exemption under the Water Act is needed. A servitude may not be created if other law forbids its use, and creating the servitude does not replace any required authority permit. For certain servitudes, use does not require the owner’s consent under the Water Act. If using an easement requires building or improving a road, building a structure, or otherwise restoring the easement area, the affected property owners must be allocated the restoration costs; if they cannot agree, the allocation is based on the benefit each party gets from the easement. If joint drainage is carried out in a property survey, the rules in the Water Act on forming a drainage association for a drainage survey apply to that formation.
