About this statute

A person who has requested an action from the Border Guard and whose immediate rights are affected is entitled to be told why the Border Guard does not take the action. Police, customs, and pre-investigation tasks must follow the principles set out in the specified laws and related laws governing those tasks. A border guard officer may conduct body searches, without suspicion of an offence, for border checks and border surveillance under the Schengen Borders Code. A border guard may ask a person for identity details, identify them by appearance if needed, and arrest them if they refuse or give likely false information, with release required within 24 hours.
