About this statute

This section points to other provisions about credit institutions’ obligation to belong to the investor protection compensation fund and about how the investment services act applies to credit institutions providing investment services. This section defines which entities count as financial institutions. Only credit institutions may carry on business that consists of taking repayable funds from the public, except as otherwise provided in Section 20. Aktiebolag och andelslag may receive repayable funds from the public through certain debt instruments, but if those instruments are offered to the public outside a securities issue, they must prepare and publish interim reports, financial statements and bulletin reports. Vid en inlåningsbanks koncessionsansökan ska Insättningsgarantifondens yttrande begäras. Om ett kreditinstitut enligt bolagsordningen eller stadgarna kan tillhandahålla investeringstjänster ska också yttrande begäras av ersättningsfonden för investerarskydd.
