About this statute
This provision defines when a dividend counts as a dividend from a publicly listed company. The provision treats certain futures-contract gains like gains from property transfers, and says the gain is calculated without reducing the transfer price by the minimum amount referred to in section 46(1). The section says certain derivative expirations and certain final losses in securities value are treated as transfer losses. A listed company may deduct its loss if more than half of the shares not traded on a regulated market have not changed owner.
