Lag om ändring av patentlagen

The applicant may appeal a final patent authority decision on a patent application if the decision is adverse. In opposition cases, the patentee or the person who filed the opposition may appeal if the decision is adverse.

About this statute

The applicant may appeal a final patent authority decision on a patent application if the decision is adverse. In opposition cases, the patentee or the person who filed the opposition may appeal if the decision is adverse. In patent appeal cases, the applicant or patentee must submit Finnish or Swedish translations when required, and the Market Court may impose a fine or arrange translation at the patentee’s expense if a translation is not filed on time. Domstolen meddelar tvångslicens och bestämmer omfattning, vederlag och villkor; den kan också upphäva licensen eller ändra villkoren om förhållandena väsentligen ändras. Marknadsdomstolen ska handlägga vissa tvistemål och ansökningsärenden, och den kan kräva översättning av en patentskrift till finska eller svenska i vissa patenttvister. Certain patent-related criminal cases and related claims are handled by Helsinki District Court, and the court can require patent-scrift translations in some cases.
