Statsrådets förordning om ändring av patentförordningen

If Patentverket finds that the certificate cannot be issued, it must issue a decision. The person who requested the examination may appeal to the Market Court. Decisions of the Patent and Registration Office appeal board or the specified Market Court decision may not be appealed.

About this statute

If Patentverket finds that the certificate cannot be issued, it must issue a decision. The person who requested the examination may appeal to the Market Court. Decisions of the Patent and Registration Office appeal board or the specified Market Court decision may not be appealed. Patentverket must consider all facts it knows about when examining patentability, and it must base the review on specified patent documents and published applications. It may also use other available literature if justified. Patent notice may be postponed, on the applicant’s request, until the application becomes public. Patentverket must make entries in the patent register when notified of certain patent-related actions and court decisions. A translation is required for an international patent application if it was filed in a language other than the one specified in the patent law, when the application is continued under 31 § or when examination is requested under 38 § 1 mom.
