About this statute

The provision says the law concerns making copies of orphan works and making orphan works available to the public. Upphovsmannen har rätt till ersättning för utlåning av exemplar till allmänheten, men bara inom vissa tids- och användningsgränser. Vissa arkiv- och tidningsrelaterade användningar får också göras med avtalslicens. Copyright in a specifically created musical work with lyrics lasts until the end of the 70th year after the death year of the last surviving lyricist or composer. If a recorded performance is released or otherwise made available to the public within 50 years, the protection period runs to the end of the 70th year after first release/public availability; for the subsection 3 case, it runs to the end of the 50th year. A transfer of the right to record a performance on film also includes rental distribution rights unless otherwise agreed. This section sets when protection for a sound recording lasts, and gives performing artists a right to terminate certain rights-transfer agreements and to receive additional remuneration after 50 years in some cases.
