About this statute

If a home or other occupied space has a sanitary nuisance, action must be taken without delay to investigate, fix, or limit it. Responsibility can rest with the building owner, the occupant, or the municipal health authority depending on the cause and severity. Hälsoskyddsmyndigheten may inspect and arrange inspections-related investigations, and the person carrying out an inspection or investigation is entitled to enter relevant premises, obtain needed information, and take measurements, photos, recordings, and representative samples. Home-premises inspections are limited: authorities may inspect permanent residences only in specified necessity or suspicion cases, and non-authorities may not inspect them. External experts used in health protection supervision must be competent, use reliable methods, and certified persons must be registered and periodically renewed. Kommunen får ta ut avgift enligt en av kommunen godkänd taxa för vissa inspektioner och utredningar om sanitära olägenheter, men den första inspektionen för att utreda en misstanke är avgiftsfri.
