Statute overview

About this statute

An applicant for international protection must file the application with the police or border control authority promptly, and the authority must register it without delay. This section sets out who investigates asylum matters, how asylum interviews are run, and several safeguards for the applicant. The provision sets conditions for treating a country as a safe asylum country or safe third country, and requires a document in the relevant country’s language when a person is sent back to a safe third country. En asylansökan kan bedömas som uppenbart ogrundad om den saknar trovärdiga grunder, om sökanden missbrukar asylförfarandet, eller om sökanden kommer från ett säkert ursprungsland. A “new application” means a later international protection application filed after a final decision on the earlier one, subject to an exception for certain lapse decisions. If a new application is filed while the case is still pending, the applicant’s submitted information must be sent to the deciding authority as new material.
