Statute overview

About this statute

Helsingfors tingsrätt decides on extradition and continued detention. District prosecutors in the Helsinki District Court district may handle the prosecutorial duties covered by this law, unless the law provides otherwise. In special cases, another prosecutor may also be competent. If the person sought to be surrendered has been taken into custody, that person must be heard at the district court hearing about the prosecutor’s application. The person sought for extradition must tell the district court hearing whether they consent to extradition, certain prosecution or detention abroad, or onward extradition. The court may use video or similar technology for the hearing, and must still bring the person to court if needed. A district court’s extradition decision may be appealed to the Supreme Court if the Supreme Court grants leave to appeal under Chapter 30, Section 3 of the Code of Judicial Procedure.
