About this statute

Finansinspektionen may inspect relevant materials at supervised entities’ and other financial market actors’ premises and may obtain needed copies free of charge. Finansinspektionen may ban a person from certain management roles in an authorised supervised entity for up to five years, and may permanently ban a person from certain tasks in fund companies and depositary institutions if the person has repeatedly and seriously breached listed rules. The sanction fee amount must be based on an overall assessment, and there are special maximum limits for legal persons and natural persons in certain cases. Finansinspektionen must publish certain sanction decisions promptly and keep sanction information on its website for five years, with limited exceptions for delay, anonymisation, or non-publication. Finansinspektionen may refuse to cooperate with a foreign EEA supervisory authority, but only in listed situations.
