About this statute

Patenthavaren har ensamrätt att utnyttja uppfinningen, och andra får inte göra vissa patentskyddade handlingar utan lov, med flera uttryckliga undantag. An invention may be used on a foreign vessel, aircraft, or other means of transport for its own needs when it temporarily or accidentally enters Finland; spare parts and accessories for aircraft may also be imported and used in Finland to repair a foreign aircraft. A patent application must be filed in writing with the patent authority, and the patent authority must keep a register of incoming patent applications. Patentmyndigheten ska ta bort vissa registrerade anteckningar när de upphört och anteckna utmätning av patent när utmätningsmannen anmäler det. A person who was commercially using a patent-applied invention in Finland when the application became public may be entitled to a compulsory licence if the application later leads to a patent and certain conditions are met. The same can also apply to someone who has taken substantial steps to use the invention commercially in Finland.
