About this statute

Chapter heading about the principles of preliminary investigation and the rights of participants in a preliminary investigation. If a suspect does not want a helper/counsel, the investigating authority must, when needed, make sure the suspect is properly informed about the suspicion, the right not to cooperate in the investigation, and the right to use counsel at the pre-investigation stage and in court. A party’s counsel and a victim’s support person may attend the hearing of their principal, unless the investigator prohibits it for weighty crime-investigation reasons. The investigator may allow certain people to be present during the confrontation if identification is not made harder, and the prosecutor must be given an opportunity to attend.
