About this statute
Chapter 1: General provisions. This section defines when a business transfer occurs and says the employer’s employment-related rights, obligations, and linked benefits pass to the new owner or holder. Employers must offer work back to certain former employees who were dismissed and are still job-seeking, if suitable work arises within the stated re-employment period. The buyer of a business may not dismiss an employee solely because of the transfer. Employees may terminate their contract under special timing rules linked to notice of the transfer.
