Statute overview

About this statute

Reglerna tillåter vissa säkringsåtgärder mot utlänningar och kan kräva boende och anmälan på förläggning. A child may be taken into custody only if the statutory precondition exists, other security measures are found insufficient and custody is necessary as a last resort, the child has been heard before the decision, and an appointed social worker has been given an opportunity to be heard. A deciding official must report a detention or child residence-duty matter to the district court promptly, and the court must hear the case within the stated deadlines. The district court must decide where a detained person is to be placed when custody continues, and it must order a return to the aliens’ detention facility if the person can no longer remain at the remand-prison location. A foreigner who intentionally commits one of the listed immigration-related acts may be fined for an alien offence.
