About this statute

The provision lets a court order detention arrest instead of detention in custody, and sets the person’s stay-at-home, contact, reporting, and monitoring duties. A defendant in an appeal case should be given a chance to respond to a request for detention or detention arrest, unless the request is immediately dismissed or denied, or the defendant is abroad or at an unknown location. This section limits some appeals in detention and detention-arrest matters, but allows specific complaints by the detained person, certain officials, and in some cases the detained person or a person under detention arrest. It also lets a court impose strengthened travel restriction with home-stay hours if conditions are met. Domstolen ska pröva om reseförbud ska ges i stället för häktning, och den kan besluta om reseförbud även innan åtal väcks. A decision on travel ban must state the reason, basis, content, consequences, duration, and the right to have the matter reviewed by a court; special travel bans must also state the technical monitoring method.
