About this statute

This section defines “other financial market participants” to include insurance intermediaries and side-business insurance intermediaries, including foreign insurance intermediaries registered in another EEA state than Finland. Paragrafen says its rules on restricting business also apply to certain insurance associations, certain agents’ registrations, and certain third-country investment firms; it does not apply to the central institute of the deposit banks association. Finansinspektionen may temporarily bar a person from certain leadership roles at an insurance intermediary or ancillary insurance intermediary, for up to five years, if the intermediary has breached specified procedure rules. A penalty fee must be imposed on anyone who intentionally or negligently breaches the listed rules or decisions. Finansinspektionen ska övervaka att certain financial market actors follow the rules that apply to them on marketing, contract terms, and customer conduct; the rule also applies to certain foreign actors when the authority is competent.
