About this statute
If a maintenance-support claim is brought within one year after parentage is established, the parent may be ordered to pay support from the child’s birth, but not for more than the five years before the claim was filed. A court may order a child’s representative to repay child support payments, if the parentage matter has been finally set aside or found invalid, and the representative knew the payer was not the child’s parent and repayment is reasonable. A child’s representative may request a court determination of child maintenance when a parentage case is being brought. A maintenance claim may be handled by the same court as the related custody or paternity case. When a paternity case is brought against more than one person, the child support issue may not be decided until paternity has been established by a final judgment.
