About this statute

A missing person may be declared dead by a court or the Digital and Population Data Services Agency under this law. A person may be declared dead by decision of the Population Information System authority once both time conditions are met. The Finnish Digital and Population Data Services Agency must, every year and on its own initiative, check whether the population data system shows that people who could be declared dead under section 12 are alive. If the condition for a declaration of death in section 12(1) exists, the Digital and Population Data Services Agency must gather the investigation it can reasonably obtain about whether the person has been alive during the last five calendar years. If there are grounds to declare a person dead, the Digital and Population Data Services Agency must summon the person to report by a fixed date and notify other people who may know whether the person is alive or dead.
