A person responsible for operating a vessel, or for a task that significantly affects its traffic safety, can be convicted if they breach the sea traffic act, regulations issued under it, or the 1972 collision-avoidance convention. A person responsible for operating a vessel, or a task that materially affects vessel safety, may be convicted of gross endangerment of traffic safety if they intentionally or through gross negligence ignore specified navigation rules and thereby create serious danger to another person’s life or health. A person can be punished for an environmental offence if they intentionally or through gross negligence breach certain vessel-use duties, marine traffic rules, or area/vessel-specific prohibitions or restrictions, and the act is capable of causing environmental danger.
