About this statute

This section defines several terms used in the law, including seafarer, employment relationship, unpaid time, pension-related concepts, EU social security rules, and related family/status terms. A surviving spouse may be entitled to survivor’s pension if the marriage or cohabitation and child/household conditions in this section are met. A child under 20 may be entitled to child pension if the deceased beneficiary’s child or, in some cases, the child of the surviving spouse lived in the same household; the section also limits entitlement to at most two deceased beneficiaries and says earlier child pension can end when pension from the child’s own parent starts. Rätten till efterlevandepension och barnpension upphör i vissa situationer, bland annat efter viss tid, när ett barn fyller 18 eller 20 år, eller när den efterlevande maken gifter om sig före 50 års ålder. If there is no evidence of a person’s death but death is probably due to drowning, another accident, or a comparable cause, the pension institution must determine the probable date of death and grant family pension from the start of the following month.
