About this statute

This provision defines “surviving spouse” for this law. En efterlevande make kan ha rätt till efterlevandepension om vissa äktenskaps-, sambo-, barn- och åldersvillkor är uppfyllda, men rätten begränsas av flera undantag. The surviving spouse’s beginning pension ends when the youngest child entitled to family pension turns 18, if the spouse is entitled to survivor’s pension under 26 § 1 mom. 2 punkten; it also ends if the spouse remarries before age 50, and in any case no later than the start of the month after the spouse turns 65. Regler om när en efterlevandepensions fortsättningspension upphör, bl.a. efter tio år, när barn fyller 18, vid nytt äktenskap, vid beviljad annan pension eller senast vid 65 år. If survivor pension has been paid for at least one year and is withdrawn because the surviving spouse remarries before age 50, a one-time payment is made to the spouse.
