Statute overview

About this statute

This is a chapter heading for general provisions. Rules on biological medicines in this Act also apply to biosimilars. This provision defines biological medicine, biological substance, and biosimilar, and requires prescribers to choose the lowest-priced comparable biological medicine unless patient-specific medical or therapeutic reasons justify a different choice. An electronic prescription must include information needed to decide any sickness insurance reimbursement, any substitution ban, and the medical or therapeutic reasons for not prescribing a cheaper comparable alternative biological medicine. Certain prescription and dispensing data about biological medicines may be disclosed to a prescriber and to the prescriber’s employing or commissioning healthcare unit when needed for self-monitoring or for information and reports required for authority supervision.
