About this statute

This chapter concerns war crimes and crimes against humanity. The provision criminalizes certain acts as crimes against humanity and punishes enforced disappearance committed by a state representative or with state authorization, support, or consent. A military superior or other superior may be sentenced as a principal or participant for listed offences, including attempts, if subordinates under their actual authority commit the acts because the superior failed to supervise properly and failed to take necessary reasonable preventive measures. A military superior or other superior who fails to take necessary and reasonable steps to bring a suspected subordinate offence to the authorities can be fined or imprisoned for up to two years.
