About this statute

A public area may be subdivided only if the municipality has title to the area, or acquired it under specified land-use provisions, and the relevant properties are free of mortgages or the area is released from them under specified provisions. A parcel outside a detailed plan area may be created by subdivision only if it meets building-site requirements and does not hinder planning in certain listed situations. If there is uncertainty whether the land lies in a shoreline area, the surveying engineer must refer the matter to the ELY Centre. If, during subdivision, the parties concerned have a mistaken understanding of the building conditions, the survey engineer must explain how the subdivision affects the assessment of building requirements. When subdivision is carried out outside a detailed plan area, properties that will include buildings needing a building permit should, if possible, be formed so they meet the requirements for a building site. When building land is regulated, certain public areas intended for the municipality’s needs are set aside for the municipality, except where the land is already municipally owned.
