Statute overview

About this statute

This Part sets commencement rules for the Order and gives the Department and the Regulator several administrative and enforcement powers. This provision lets the Regulator manage freezing orders for occupational pension schemes, including extensions, validation of contraventions, notifications, and related directions. It also sets time limits, links breaches to civil penalties, and gives the Authority power to prohibit unfit trustees and appoint independent trustees. The Regulator can issue contribution notices, clearance statements, directions, financial support directions, and restoration orders, and several related payment and compliance rules apply. This provision requires registrable pension schemes to notify the Regulator, provide registrable information, file scheme returns when asked, and comply with inspection and reporting powers. It also sets public-access limits for the prohibition register and creates offences and penalties for non-compliance. The provision makes it an offence to give the Regulator false or misleading information in a material respect, restricts disclosure of restricted information, and sets out related penalties, reporting duties, and procedure/codes-of-practice powers for the Regulator.
